The Grand Emporium LLC, DBA Emporium Rentals

Rental Agreement

 This is a contract between you, the renter, and us, The Grand Emporium LLC, DBA Emporium Rentals. Please read it carefully.

 1. Key Definitions

 You/Your: The person who signed this agreement and anyone who is approved by us to drive the vehicle. You are all responsible for this agreement.

  • We/Us/Our: The Grand Emporium LLC, DBA Emporium Rentals.

  • Authorized Driver: You, any additional driver we've approved and listed on this agreement, and anyone else authorized by Virginia law, as long as they have a valid driver’s license and are at least 19 years old.

  • Vehicle: The car you're renting, including its keys, tires, tools, documents, and all equipment.

 2. Condition and Return

 Vehicle Condition: You received the Vehicle in good condition and agree to return it in the same condition, except for normal wear and tear.

  • Service & Repairs: Any service, replacement of parts, or repairs to the Vehicle must be approved by us in advance.

  • Return: You must return the Vehicle to us on the date and time specified in this agreement. If you wish to extend your rental, you must get our written approval and have the vehicle inspected by us before the original return date.

 3. Our Policies & Your Responsibilities

 Our Promise: This is a rental contract only. We provide no other warranties, express or implied, regarding the Vehicle's condition or fitness for any purpose. We can repossess the Vehicle at your expense if it is abandoned or used in violation of this agreement or the law.

  • Your Responsibility for Damage: You are responsible for all damage to or loss of the Vehicle, regardless of who is at fault. This includes the cost of repairs, towing, and any other administrative costs we incur.

  • Reporting: You must report all accidents, incidents, and damage to the police and to us immediately.

 4. Liability and Insurance

 We Do NOT Provide Insurance: You understand that The Grand Emporium LLC, DBA Emporium Rentals does not provide any insurance coverage for you, the Vehicle, or any damages or losses you may cause to others.

  • Your Responsibility: You are fully responsible for any and all damages you cause to others. You agree to provide your own auto liability insurance to cover you, us, and the Vehicle. Your coverage is void if you violate this agreement. You agree to protect us from all liability, costs, and fees that arise from your use of the Vehicle.

  • Rideshare & Delivery Exclusions: Please note that vehicles used for rideshare (Uber, Lyft, etc.), delivery, or courier services are NOT covered by our insurance. You will be held responsible for all damages, liabilities, or costs incurred while using the Vehicle for these purposes.

 5. Prohibited Uses

 Any of the following actions will be considered a violation of this agreement, and any coverage you have may become void. You agree NOT to:

  • Allow an unauthorized driver to operate the Vehicle.

  • Drive while under the influence of drugs or alcohol.

  • Engage in reckless driving, including off-roading, or carry explosive/hazardous substances.

  • Exceed the maximum passenger count or use the Vehicle for hire (including rideshare or delivery).

  • Use the Vehicle for any illegal activity or in any speed contest.

  • Tow or push any other vehicle.

  • Provide false information to us.

  • Drive outside of the continental United States.

  • Leave the keys in an unlocked Vehicle.

 6. Charges

 You will pay us on demand for all charges due, including:

  • Rental time and mileage for the period you keep the Vehicle.

  • Applicable taxes and fees.

  • All costs for damage to or loss of the Vehicle, including repairs, loss of use, and our administrative fees.

  • Any fines, penalties, court costs, or towing charges assessed against us during your rental.

  • All expenses we incur in locating and recovering the Vehicle if you fail to return it.

  • All costs we incur collecting payments from you, including attorney fees.

  • A late payment fee and interest on all overdue amounts as allowed by law.

 7. Other Important Terms

 Modifications: This agreement can only be changed with a written amendment signed by us.

  • Entire Agreement: This agreement contains all the terms between you and us. Any other agreements or representations are not part of this contract.

  • No Waiver: If we do not enforce any term of this agreement, it does not mean we waive our right to enforce it later.

Geographic Restrictions

You agree to operate the Vehicle only within a 100-mile radius of our office location in Fredericksburg, Virginia, and within the states of Virginia, Maryland, and Washington, D.C.

You agree that if the Vehicle is operated outside of this designated area, Emporium Rentals, LLC cannot provide any roadside assistance, support, or recovery services, and the renter will be solely responsible for all costs associated with towing, repair, and any other expenses incurred.
